As many of you all know, my car was totaled out from hail damage. However, after buying it back, I’m not sure where to go from here. I was told it was going to be a total loss 3 weeks ago, but I was able to renew the registration last week. I’ve talked to a few people, who said on a car bought back from insurance that legally you’re expected to tell the state it’s salvaged, but there’s nothing forcing you to do so. So my question is, can I just keep going how it is and sell it with a clean title? I would obviously let the buyer know the situation but it would save me a lot of time and trouble if I could do that.
Hypothetically, of course.
Also, if you’re an Illinois Oppo or have experience rebuilding a car that has hail damage or is over 9 years old in Illinois, please leave a comment!

If there’s no legal mechanism forcing you to salvage title it, why do it? However, when you buy it back, it should be issued a new title, which will say salvage on it.

That’s what I thought but our insurance never took possession of the title or even the car. I guess we’ll find out when I get the check.
And technically I’m legally obligated to but it’s on good faith

Also it is listed on NICB as salvage

At least in PA, I believe that if you buy the vehicle back before the insurance company totals it. You still have a clean title. I could be wrong, I have limited knowledge on this

I'd just do nothing unless an issue came up

Hail damage can be repaired with a pdr guy. And as long as it’s repaired and you go to sell it, you might as well disclose it. Shouldn’t matter to the next buyer. As long as you don’t bondo and respray the car to hide the damage, it’s all good.

It depends on your plans. If you’re going to keep it and drive it until it’s old and kinda worthless, do nothing. If you’re gonna want to sell it tomorrow, probably should do the paperwork.
Hail is a stupid-ass reason for a car to get salvaged anyway , IMO. They’re just speed dimples. Salvage titles should be relegated to only cars that were determined to be inoperable.

Oh, weird.
And yeah, technically I’m legally obligated to report purchase price on cars so I can pay tax on them, but...

Non-classic cars aren’t worth buying back. If the insurance company totals it, it’s because it really is a total loss!
Sell it as a salvage title for half the Edmunds book
value. Even then, it could take months to unload it.
NEVER buy a car back from insurance if you EVER plan on selling it! You won’t get anywhere near what you want to get for it! The only time it’s ever a good idea to buy it back, is if it has sentimenta value to you or is a classic, and you plan on driving it until it’s dead and time to bring it to a junkyard.
The only time you’d ever want to buy a car with a salvage title is if you can get it CHEAP, and you plan on driving it until it’s scrap.

It is my understanding that you aren't actually supposed to drive a car with a salvage title. You can fix the damage and get a reconstructed title (R-title), but until you do that, you just have a parts car. That's what I was told.
I lived in North Carolina at the time, so your mileage may vary. But my 2004 Honda Civic was totalled from minor flood damage from Hurricane Matthew. The engine was fine but there was water in the cabin and a strong mildew smell. Insurance offered me 3800 to tow it away or they’d pay me 3400 and I could keep it. So I kept it and drove it for a few years after gutting it and dealing with the water damage. It ran fine, and I never received a salvage title. I was just told that I had to disclose that if I sold it. I then moved to PA, got an R-title for the Civic, and gave it to my brother.

I would just drive the car until it's too old and rusty to be worth anything anyways.

They may still want the title in exchange for the check.

I’m not sure about the front end (registration and all that), though I’d suspect if you try to sell it on as having a clean title later you’d open yourself up to getting sued. Also, the other folks on here are right about the resale later with a salvage title, it’ll be worth half or less of the book value even if it is only hail damage..
Before deciding on a final move you might want to double check that the DMV does not have recourse to fine you for continuing to register the old title when a new one had been issued..

I’m planning on selling it within a few weeks, but if I could avoid the paperwork I could save a lot of time, money, and headache

That’s along the lines of what I’m thinking, but just disclose it instead of going through the title mess. Illinois charges fees for everything, including charging $100 to change it from a clean title to salvage then $150 to go from salvage to rebuilt!

It’s only hail damage, so there’s nothing to fix. Plus it’s too late as I already bought it back. Everything I was told/seen said just buy it back

I’m not even gonna do pdr, that’s what totaled it in the first place. I’ll list it for cheap, disclose what happened to it, and sell it as-is

Already bought back, so they just gave less on the check

Both my dad and I agree, it’s a good time to get something else. His reasoning is so I can get something with lower miles and I’m getting bored with it and want something different.

It probably is best to just let the insurance company take it then.

Too late for that. Idea was buy back, rebuild (which I have no problem doing but if I don’t have to then even better), then sell for $2750, or about $1500 less than the car would be worth without the dents

Well then, good luck. Everything I've learned about that process, I learned from you.

The whole process was a pain. I needed an “enhanced inspection” to prove that it was fixed (even though it was just a matter of dealing with mildew, not structural damage).
If I had just kept my mouth shut, I probably could have walked into a PA notary and gotten a clean PA title by showing them my clean NC title. They actually told me that when I was there. But because I was honest about it, I had to get a salvage certificate and the an R-title. And now my brother is still driving that Civic as it approaches 200k miles.

Wow. Then I guess its just up to you. I’d be happy to have it back on the original title because it means (depending upon your state) that you don’t have to jump through the hoops to get a rebuilt title and all that entails, like certified rebuilder, inspection, taxes, etc.
It seems you have a clean title but a clouded history. It may come back to bite you or the next owner (which I would definitely inform) when you sell it, but for now I’d count myself as fortunate.

Try one of these. My cousin had a hail damaged Camry and all pulled out. Literally looked like nothing happened,.

I had an update that I was going to email you but just gonna put it here. Something came up that took me out of the position to buy a car, so sadly unless things turn around soon I cannot make any sort of big purchase like that. I will keep you posted in case we find a way but still it looks to be this way and it truly sucks. However, you might still have a buyer in my uncle for his son or himself to do something with so I’ll continue to email you regarding that. Super sorry, man. I am just as disappointed as you are.

Hey it’s all good, stuff happens. It probably works out better that way because there’s a good chance I’ll be buying a car Thursday or Friday, so I’ll be needing to sell mine pretty quickly because as fun as it would be to own 2 cars I also can’t afford that

Interesting...is it anything you've posted here before because ain't none of them bright colored....let me guess, you flipped the script and got something completely different? Either way it's gonna be cool, can't wait for the reveal.

I have not posted it on here, and it’s a brighter color than what I would’ve preferred but it’s an incredible deal. Hopefully I’ll have all the deets tomorrow, if the insurance check clears I’ll be buying it tomorrow evening.
